- PRIMERO. DECLARAR que la Sala de Casacion Penal de la H. Corte Suprema de Justicia es competente para decidir sobre el conflicto de competencia de orden territorial, surgido entre el Tribunal Superior del Distrito Judicial de Cucuta, Sala Penal, y el Tribunal Superior del Distrito Judicial de Santafe de Bogota, Distrito Capital.
- SEGUNDO. REVOCAR la decision dictada por la H. Corte Suprema de Justicia, Sala de Casacion Penal, el nueve (9) de noviembre de mil novecientos noventa y cuatro (1994).
- TERCERO. ORDENAR el envio del expediente a la Sala de Casacion Penal de la H. Corte Suprema de Justicia, para que defina el conflicto de competencia entre el Tribunal Superior del Distrito Judicial de Cucuta, Sala Penal, y el Tribunal Superior del Distrito Judicial de Santafe de Bogota, Distrito Capital.
